Matt Hodgkinson<p>Energy companies are vultures. I had this many years ago at a London flat, where a 'debt collection agency' kept sending red-lined demands to "The Occupier" for a previous tenant's debt. I faxed them a cease and desist letter - and the fax machine showed that the recipient was the energy company, the debt collector being a fake front operation. They desisted.</p><p><a href="https://www.theguardian.com/money/article/2024/may/06/bills-you-dont-owe-menacing-debt-collectors-the-terrifying-world-of-energy-company-customers" rel="nofollow noopener noreferrer" translate="no" target="_blank"><span class="invisible">https://www.</span><span class="ellipsis">theguardian.com/money/article/</span><span class="invisible">2024/may/06/bills-you-dont-owe-menacing-debt-collectors-the-terrifying-world-of-energy-company-customers</span></a></p><p><a href="https://scicomm.xyz/tags/DebtCollection" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>DebtCollection</span></a> <a href="https://scicomm.xyz/tags/EnergyCompanies" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>EnergyCompanies</span></a> <a href="https://scicomm.xyz/tags/EnergyBills" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>EnergyBills</span></a> <a href="https://scicomm.xyz/tags/UKenergy" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>UKenergy</span></a> <a href="https://scicomm.xyz/tags/ConsumerLaw" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>ConsumerLaw</span></a></p>
MikeWas<p>Knowledge is the antidote to fear.</p><p>When a debt collector comes at you, your fear is their friend.</p><p>They use fear against you to extract money they didn't earn and don't deserve.</p><p>But if you know how the law protects you from unfair and abusive debt collection, you have the upper hand.</p><p>And you don't have to fear them anymore.</p><p>We'll give you the knowledge—for free. Check the link below.</p><p><a href="https://esq.social/tags/FDCPA" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>FDCPA</span></a> <a href="https://esq.social/tags/DebtCollection" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>DebtCollection</span></a></p>
MikeWas<p>Four common ways debt collectors break the law:</p><p>1. Calling you on the phone when they know they shouldn't</p><p>2. Misrepresenting the amount of a debt</p><p>3. Using false statements in court proceedings</p><p>4. Trying to collect a debt after the statute of limitations has passed</p><p>If a debt collector has broken the law while collecting a debt from you, you can sue them. Turn the tables and make THEM pay YOU instead of the other way around.</p><p><a href="https://esq.social/tags/FDCPA" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>FDCPA</span></a> <a href="https://esq.social/tags/DebtCollection" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>DebtCollection</span></a></p>
MikeWas<p>And it's right there in black and white: the evidence that they knew all along they were lying.</p><p>When you catch debt collectors in a lie, you've got them over a barrel.</p><p>You can sue under the FDCPA, and recover $1,000 statutory damage claim—and in many cases, wipe out the debt forever, never to be heard about again.</p><p>Learn how to dispute, and learn how to make them pay for their lies. Ask me how.</p><p><a href="https://esq.social/tags/FDCPA" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>FDCPA</span></a> <a href="https://esq.social/tags/DebtCollection" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>DebtCollection</span></a></p>
MikeWas<p>The smoking gun is usually right there in the debt collector's files.</p><p>They lie about simple things, like due dates, or the amounts owed, or the dates of last payment.</p><p>And then we dispute the debt, and find out they knew the truth all along.</p><p>How'd we find out?</p><p>A properly-worded dispute letter to the debt collector often means they cough up the account statements.</p><p>👇</p><p><a href="https://esq.social/tags/FDCPA" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>FDCPA</span></a> <a href="https://esq.social/tags/DebtCollection" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>DebtCollection</span></a></p>

A digital voice agent—the new incarnation of a robocall, using AI chatbots and text-to-speech capabilities for dynamic, responsive conversations—could make millions of outbound calls in just a few days, the company claimed, contacting and requesting payment from a collection agency’s entire portfolio of debtors at a far lower cost than human staff.</p><p>Human agents could use AI at every stage of the collection process, the company’s blog claims, delivering “instant scalability” through “end-to-end automation,” which of course would boost productivity and lower costs. On the other hand, for someone on the other end of the call, the chance to speak with an actual human during the process becomes ever more distant."</p><p><a href="https://www.vice.com/en/article/bvjmm5/debt-collectors-want-to-use-ai-chatbots-to-hustle-people-for-money" rel="nofollow noopener noreferrer" target="_blank"><span class="invisible">https://www.</span><span class="ellipsis">vice.com/en/article/bvjmm5/deb</span><span class="invisible">t-collectors-want-to-use-ai-chatbots-to-hustle-people-for-money</span></a></p>
MikeWas<p>If a debt collector has misled you, lied to you, or tricked you in any way, you get to sue them and make them do the right thing—even if they don't want to.</p><p><a href="https://esq.social/tags/FDCPA" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>FDCPA</span></a> <a href="https://esq.social/tags/DebtCollection" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>DebtCollection</span></a></p>
MikeWas<p>If I could only use one part of the law to fix debt collection abuse, "false and misleading" is the one I'd use. Because debt collectors fall into this trap all the time.</p><p>Now, there are dozens of other ways debt collectors violate this law—especially when they try to sue consumers—but these are the top two.</p><p>👇<br><a href="https://esq.social/tags/FDCPA" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>FDCPA</span></a> <a href="https://esq.social/tags/DebtCollection" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>DebtCollection</span></a></p>
MikeWas<p>2. If the debt collector reports ANY information to the credit bureau that's not accurate—any date, any balance, any payment amount, any other number that's objectively false— you've caught them red-handed in a violation.</p><p>👇<br><a href="https://esq.social/tags/FDCPA" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>FDCPA</span></a> <a href="https://esq.social/tags/DebtCollection" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>DebtCollection</span></a></p>
MikeWas<p>So if you have a green card showing they got your dispute letter and you have a credit report showing they later told a credit bureau about your debt, and they didn't note that the debt was disputed, you've caught them red-handed in a violation.</p><p>👇<br><a href="https://esq.social/tags/FDCPA" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>FDCPA</span></a> <a href="https://esq.social/tags/DebtCollection" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>DebtCollection</span></a></p>
MikeWas<p>This one, we also see a lot. Debt collectors LOVE to report debt to credit bureaus. They don't love reporting those debts ACCURATELY. There are two ways we see this come into play:</p><p>1. If you've disputed the debt to the debt collector, and anytime after, they report to a credit bureau, they often "forget" to report that the debt is disputed. </p><p>👇<br><a href="https://esq.social/tags/FDCPA" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>FDCPA</span></a> <a href="https://esq.social/tags/DebtCollection" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>DebtCollection</span></a></p>
MikeWas<p>Do you think the balance is wrong? Have they padded their fees or added unauthorized charges? That's probably a violation of §1692e(2) and a good reason to sue for damages.</p><p>Subsection (8) bans false reporting to credit bureaus, and bans failing to include that a debt is disputed if reported to a credit bureau.</p><p>👇<br><a href="https://esq.social/tags/FDCPA" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>FDCPA</span></a> <a href="https://esq.social/tags/DebtCollection" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>DebtCollection</span></a></p>
MikeWas<p>Here are the ones that we use most often to sue debt collectors and level the playing field for our clients:</p><p>Subsection (2) bans false statements about the character, amount, or legal status of a debt, or false statements about fees the debt collector may charge.</p><p>This means if they overcharge you, or lie about the amounts due on the account, or mislead you about whether you owe it, they're breaking the law. This may be the single most common reason we sue.</p><p>👇<br><a href="https://esq.social/tags/FDCPA" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>FDCPA</span></a> <a href="https://esq.social/tags/DebtCollection" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>DebtCollection</span></a></p>
