It’s *possible* as some are saying that whoever altered the photo did so to explain the tattoos.

1. If that is the case, I doubt #Trump realized it.

2. MS-13 is notorious for boldly displaying the gang’s name in their tats. They don’t use code.

3. The neo-Nazi that came up w/this tattoo theory claims the cross & the skull are covering what used to be a 1 & a 3. That skull for sure was not a 3.

When #DOJ released the Gang Field Interview Sheet in the #KilmarAbregoGarcia case, they redacted the name of the cop...the one who was suspended & then indicted for serious professional misconduct. But Sargent & TNR obtained the GFIS & confirm that the name is under the first redaction bar.

But here's the thing: Even if you allow that Abrego Garcia might have been in MS-13, the government still can simply return him, go into an immigration court, and relitigate his initial "withholding of removal" status. Or, alternatively, the government can seek to deport him to a third country, which isn't precluded by that status.
In short, the choice is not necessarily between (1) leaving him to rot in a foreign prison after sending him there illegally and 2) bringing him back to roam free inside the United States for the rest of his life. Rather, it's between (1) leaving him to rot in a foreign prison after sending him there illegally and (2) retrying him in the United States and seeking his deportation that way, if the government so chooses. "If the government brings him back, they can let him go back to living his normal life, or they can seek to remove him properly," says American Immigration Council senior fellow Aaron Reichlin-Melnick. Greg Sargent & TNR obtained the GFIS, & reported that the #cop who filled it out was SUSPENDED soon after for SERIOUS MISCONDUCT: sharing case info with a sex worker.

This doesn’t settle the matter, but it casts more doubt on the process designating #KilmarAbregoGarcia as MS13.
